β MARK LONG I SHRAPNEL CEO (@marklengthy)

Shrapnel developer Neon Machine is taking the battle offline and into a courtroom in Delaware. Six founding directors at Neon Machine filed a lawsuit against controlling shareholder Cort Javarone, stating that Javarone is "attempting to raid Neon's coffers"βthe legal way of saying he's trying to steal their money.
4D Factory, the "future of digital entertainment" that's so future and so digital that it still uses HTTP for its website, filed for bankruptcy in SDNY earlier, and Javarone reportedly is trying to use Neon's fund to pay off $4.5M in debt. The situation escalated earlier this month when Javarone used his controlling stake to fire CEO Mark Long, take the title, and appoint two new directors to the board.
The complaint states that Javarone and his directors are preventing Neon from issuing preferred shares to Griffin Gaming and Polychain Ventures, which were provided in exchange for their $8M investment in Neon in 2021. Javarone is attempting to maintain his majority control over the company by prohibiting investors from taking control over the assets.
Altogether, the suit aims to distribute the shares to investors, seek damages for multiple breaches of duties owed to Neon stockholders, and have Long reinstated as the company's CEO. We are also planning on suing Javarone and company for the emotional distress they've caused us this close to the launch of Shrapnel.
